Terms of Service
Welcome to XILLION, operated by Natasha Kyra Martinoff d/b/a XILLION (“Company,” “we,” “us,” or “our”) from Los Angeles, California, USA. These Terms of Service (“Terms”) govern your access to and use of https://xillion.app and all related services, applications, and features (collectively, the “Service”).
By creating an account, accessing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 18 years old to use the Service.
By using the Service, you represent and warrant that:
- You are legally capable of entering into a binding agreement.
- All information you provide is accurate and current.
- You will comply with all applicable laws and regulations.
2. Description of the Service
XILLION is an AI-powered web application that allows users to generate content, ideas, strategies, and conversational responses using third-party large language model APIs, including services provided by OpenAI and Google Gemini.
The Service may evolve over time, and we may add, remove, or modify features without prior notice.
3. Account Registration and Security
To use certain features, you must create an account.
You are responsible for:
- Maintaining the confidentiality of your login credentials.
- All activity occurring under your account.
- Promptly notifying us of unauthorized access or security concerns.
You may not:
- Share accounts with others.
- Impersonate another person or entity.
- Attempt to gain unauthorized access to systems or data.
Authentication services are provided through Supabase Auth. Passwords are stored in hashed form and are not visible to us.
4. Payments and Pricing
Access to paid features requires payment.
Pricing Structure
- The Service currently costs $97 USD as a one-time payment.
- This payment grants lifetime access on the email used at checkout.
- There is no auto-renewing subscription and no card is stored after checkout.
Applicable taxes, including VAT or sales tax, may be added at checkout through Stripe Tax functionality. Additional processor and tax-related overhead may also apply.
Payments are processed securely by Stripe. We do not collect or store full payment card numbers.
5. Refund Policy
Refund requests may be submitted within fourteen (14) days of purchase by contacting help.xillion@outlook.com.
Refunds are reviewed manually on a case-by-case basis.
We may approve refunds for situations including:
- Failure to access the Service after payment.
- Major technical issues preventing reasonable use.
- Accidental duplicate purchases.
We generally do not provide refunds for:
- Dissatisfaction with AI-generated outputs alone.
- Requests made after extensive use of the Service.
- Requests submitted after the 14-day window.
Approved refunds are returned to the original payment method through Stripe.
6. Acceptable Use
You agree not to use the Service to:
- Violate any law or regulation.
- Generate illegal, abusive, fraudulent, defamatory, or harmful content.
- Harass, threaten, or exploit others.
- Upload malware or malicious code.
- Scrape, reverse engineer, disrupt, or overload the Service.
- Circumvent rate limits or security protections.
- Use automated systems to abuse API access.
- Resell, sublicense, or operate a competing AI service using our platform without written permission.
- Infringe intellectual property or privacy rights.
We reserve the right to suspend or terminate accounts violating these Terms.
7. AI-Generated Content Disclaimer
The Service uses artificial intelligence systems that may generate inaccurate, incomplete, biased, or outdated information.
AI-generated outputs:
- Are provided for informational and creative purposes only.
- Do not constitute legal, financial, medical, mental health, or professional advice.
- Should be independently reviewed before reliance or publication.
You acknowledge that AI systems can make mistakes, and you assume full responsibility for your use of any outputs.
8. User Content
You retain ownership of the prompts, inputs, and content you submit to the Service (“User Content”).
By using the Service, you grant us a limited license to process User Content solely for:
- Operating the Service,
- Generating responses,
- Preventing abuse,
- Maintaining security and functionality.
You represent that you have the necessary rights to submit your User Content.
9. Intellectual Property
The Service, including its branding, software, design, interface, and underlying technology, is owned by Natasha Kyra Martinoff d/b/a XILLION and protected by applicable intellectual property laws.
Except as expressly permitted, you may not:
- Copy,
- Modify,
- Distribute,
- Reverse engineer,
- Sell,
- License,
- Or commercially exploit any part of the Service.
10. Third-Party Services
The Service relies on third-party providers including:
- Supabase (authentication and infrastructure),
- Stripe (payments and tax processing),
- OpenAI and Google Gemini (AI inference).
Your use of those services may also be subject to their separate terms and privacy policies.
We are not responsible for outages, interruptions, or errors caused by third-party providers.
11. Service Availability
We strive to keep the Service available and functional but do not guarantee uninterrupted access.
The Service is provided on an “as is” and “as available” basis without warranties of any kind, express or implied.
To the fullest extent permitted by law, we disclaim warranties including:
- Merchantability,
- Fitness for a particular purpose,
- Non-infringement,
- Accuracy,
- Reliability,
- Availability.
12. Limitation of Liability
To the maximum extent permitted by law, Natasha Kyra Martinoff d/b/a XILLION and its affiliates, officers, employees, and contractors shall not be liable for:
- Indirect,
- Incidental,
- Special,
- Consequential,
- Exemplary,
- Or punitive damages,
including loss of profits, data, business opportunities, or goodwill arising from your use of the Service.
Our total liability for any claim relating to the Service shall not exceed the total amount you paid to us during the six (6) months preceding the event giving rise to the claim.
Some jurisdictions do not allow certain liability limitations, so portions of this section may not apply to you.
13. Indemnification
You agree to defend, indemnify, and hold harmless Natasha Kyra Martinoff d/b/a XILLION from claims, damages, liabilities, costs, and expenses arising from:
- Your use of the Service,
- Your User Content,
- Your violation of these Terms,
- Your violation of any law or third-party rights.
14. Termination
We may suspend or terminate your access to the Service at any time if:
- You violate these Terms,
- Your use creates risk or legal exposure,
- Required by law,
- Or necessary to protect the Service or other users.
You may stop using the Service at any time.
Sections intended to survive termination will remain in effect.
15. Changes to These Terms
We may update these Terms periodically.
Updated Terms become effective upon posting to https://xillion.app.
Continued use of the Service after updates constitutes acceptance of the revised Terms.
16. Governing Law and Jurisdiction
These Terms are governed by the laws of California, USA, without regard to conflict-of-law principles.
Any disputes relating to the Service shall be resolved exclusively in the courts located within California, USA, unless otherwise required by applicable consumer protection laws.
